WHO AM I?
After completing a Bachelors w Honors in Design with majors in photography, Wesley Smith left London and emigrated to the Southern Gold Coast to follow his passions in landscape, architecture, ocean and astro photography.
Specialising in aerial (drone and helicopter) & architectural photography, Wesley has over 15 years of knowledge and expertise in photographic & digital media industry.
Working along side architects, developers, home owners and interior designers Skyris produce stunning high end photographic images for the architectural and building development community. Based on the southern Gold Coast, Australia. Skyris service the GC aswell as Brisbane and Sunshine Coast, we are also not afraid to travel interstate & international.
Skyris are 100% CASA licensed and being licensed allows us to be fully insured (something you should be aware of when picking a drone operator), this is to protect you and your clients investments.

Terms and Conditions
(Drone Services & View Assessments – Australia)
1. Acceptance of Terms
By engaging our services, requesting a quote, approving a proposal, or making payment, the Client agrees to be bound by these Terms and Conditions.
These Terms apply to all drone operations, aerial imagery, view assessments, mapping, and related services provided by [Your Company Name] (“Provider”).
2. Regulatory Compliance (CASA)
All drone operations are conducted in accordance with the Civil Aviation Safety Authority (CASA) regulations applicable at the time of flight.
Flights are subject to CASA airspace restrictions, weather limitations, safety requirements, and operational risk assessments. The Provider reserves the right to delay, reschedule, relocate, or cancel flights where required to comply with CASA regulations or safety obligations.
No liability arises from delays or cancellations required for regulatory compliance or safety.
3. Nature of Services
Drone services are provided for visual, planning, marketing, inspection, or general reference purposes unless otherwise agreed in writing.
Services do not constitute licensed surveying, engineering certification, legal boundary determination, or development approval documentation unless explicitly contracted in writing and performed by appropriately licensed professionals.
4. Altitude & Positioning Disclaimer
DJI aircraft determine altitude using a combination of onboard barometric pressure sensors and GNSS (satellite positioning) data.

The barometric sensor is calibrated at takeoff.

All recorded flight heights are measured relative to the launch location.

GNSS supports positioning and flight stability but does not provide survey-grade accuracy.
Altitude readings may vary due to:

Temperature changes
-
Atmospheric pressure fluctuations
-
Air density variations
-
Weather conditions
-
Natural barometric drift during flight
Minor discrepancies are normal and within manufacturer tolerances.
Unless explicitly contracted in writing, the Provider does not guarantee survey-grade, engineering-grade, or legally certified elevation accuracy.
5. View Assessment Limitations (New Developments)
View assessments are intended to provide a reasonable visual representation of potential views from approximate relative heights recorded during flight.
Actual views following construction may differ due to:

Finished floor level changes
-
Architectural design adjustments
-
Structural framing differences
-
Site grading modifications
-
Landscaping
-
Tree growth or removal
-
Neighbouring construction
-
Environmental conditions
The Provider does not guarantee the preservation, protection, or permanence of any view corridor.
6. Deliverables
Where applicable, the Provider will supply imagery, video, and/or a spreadsheet identifying:

Launch location
-
Recorded flight altitudes
This spreadsheet forms part of the deliverables and serves as the agreed height reference for the project.
Data reflects onboard system readings at the time of flight.
7. Client Responsibilities
The Client warrants that:

They have authority to request services at the location.
-
Required landowner permissions have been obtained.
-
Site access is safe and lawful.
-
Information provided to the Provider is accurate.
The Provider is not responsible for delays or additional costs resulting from restricted access, incorrect information, or unsafe conditions.
8. Weather & Safety
Flights are subject to weather and safety conditions. The Provider may postpone or cancel operations due to wind, rain, heat, visibility, airspace restrictions, or safety risks.
Rescheduling due to weather does not constitute breach of contract.
9. Payment Terms
Payment terms will be specified in the quote or invoice.
Unless otherwise agreed:

Payment is due within the stated invoice period.

Late payments may incur interest and recovery costs.
-
Deliverables may be withheld until payment is received in full.
10. Intellectual Property
All imagery and data remain the intellectual property of the Provider unless otherwise agreed in writing.
Upon full payment, the Client is granted a non-exclusive licence to use the deliverables for their intended project purpose.
Deliverables may not be resold, altered, or redistributed without written permission.
The Provider reserves the right to use imagery for portfolio and marketing purposes unless otherwise agreed in writing.
11. Limitation of Liability
To the maximum extent permitted under Australian law:

The Provider is not liable for indirect, consequential, or economic loss.

The Provider is not liable for differences between simulated views and final constructed views.
-
The Provider is not liable for minor altitude discrepancies consistent with manufacturer tolerances.
The Provider’s total liability for any claim is limited to the total amount paid by the Client for the specific services giving rise to the claim.
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot lawfully be excluded.
12. Indemnity
The Client agrees to indemnify and hold harmless the Provider against claims arising from:

Unauthorised use of deliverables

Construction deviations from depicted heights
-
Site changes occurring after flight
-
Misrepresentation of imagery by third parties
13. Governing Law
These Terms are governed by the laws of the State or Territory in which the services are provided.
14. Amendments
These Terms may be updated from time to time and will apply to services engaged after the date of publication.
